Pursuing a legal claim
We can help you raise a legal claim against a company that has sold you a faulty product, provided a poor quality service, or otherwise infringed on your consumer rights.
Our team will assess the circumstances of your claim and contact the party via a Letter Before Action. The party will be informed that you are pursuing a legal claim against them and will have the chance to accept responsibility or deny that they are at fault.
Negotiation or mediation
In many cases, we will be able to settle the consumer dispute using negotiation or mediation processes to secure the compensation that you deserve.
You will have all the support and information you need throughout these processes, making sure that you feel confident every step of the way.
Where your claim cannot be settled out of Court, our solicitors will help you through the relevant Court proceedings to resolve your dispute.
Small Claims Court
Where claims are valued at £10,000 or under, it is an option to pursue legal claims through the Small Claims Court. Where this is an option, we can support you to do so and explain how the process works.
For more information, see our Small Claims Court page or get in touch with our expert solicitors at Glanvilles Damant.
Court proceedings
Where disputes are more contentious and complex, particularly higher value disputes, it may not be possible to settle these via negotiation or mediation.
In these cases, our team can help you pursue a legal claim through Court proceedings. We understand that the processes may feel intimidating, and we will ensure that you receive all the sensitive and proactive support that you need.
Frequently asked questions about consumer disputes
What is consumer protection?
Consumer protection refers to the regulations and laws that are intended to protect the rights of consumers when they are purchasing goods and services.
There are various laws and regulations in place to make sure that consumers are treated fairly and receive goods and services that are up to standard.
The Consumer Rights Act 2015 is a key consumer protection law focusing on various aspects of consumer rights, including, but not limited to:
- The rights that consumers have when they are a victim of misleading advertising or unfair trading practices
- The rights that consumers have when they receive faulty goods or services
- The process that should be followed when a consumer receives faulty goods or services
- The process for routine inspections, including Trading Standards inspections
- The rules around competition and what the consequences are when breaking competition law
What types of consumer disputes are there?
There are various types of consumer disputes, for example:
- Disputes whereby a consumer has received defective goods or goods that have been misrepresented
- Disputes whereby a consumer has received services that were substandard and/or did not meet previously agreed expectations
- Disputes involving goods that are delivered late or which are never delivered at all
- Disputes involving provider and consumer contracts, for example, where a contract is misleading or unfair
- Disputes concerning data protection, for example, where a company has mishandled personal data.
At Glanvilles Damant, we can offer support with these types of disputes and many more. For more information, please get in touch.
How can I enforce my consumer rights?
If you have received a defective product or a substandard service, the first step should be to contact the provider in an attempt to resolve the problem. In some circumstances, the issue might be easily resolved, for example, a product refund or repair.
If the issue cannot be resolved, you can pursue a legal claim against the company, resolving matters using alternative dispute resolution. It is advisable to seek the support of an expert solicitor who can guide you through these processes, as well as provide bespoke legal advice.
What are my consumer rights when an item is faulty?
According to the Consumer Rights Act 2015, you will be entitled to a repair, replacement or refund if you receive a faulty item. The outcome usually depends on when you first discovered the fault in relation to the purchase of the item.
However, it is not uncommon for consumers to run into issues when attempting to obtain a refund or repair. If you cannot resolve the situation by yourself, it may be necessary to consult a solicitor who can take legal action against the provider on your behalf.
How can I make a claim?
If you feel that you may have the basis for a consumer dispute claim, you are advised to get in touch with a specialist solicitor.
Our experts at Glanvilles Damant have much experience supporting consumers to solve a wide range of legal disputes. If you would like to discuss your circumstances today, you can get in touch using the details below.
