Our divorce and family law services

Divorce

Getting a divorce is naturally a tense time, but you can trust our expert family law solicitors to empathetically guide you through every stage.

We can help you to apply for a divorce, or respond to a divorce application, then guide you through the process stages, including obtaining a Conditional Order, and eventually a Final Order, which officially brings an end to your marriage.

If you have any concerns or questions throughout the process, whether regarding your finances, children, or other matters, we can offer specialist support.

Civil partnership dissolution

Dissolving your civil partnership is often a difficult and emotional experience. At this tough time, you can rely on our expert family solicitors to guide you through with sensitivity.

We will help you through every step, from initially applying for a civil partnership dissolution to later obtaining a Final Order that legally ends your civil partnership.

Financial settlements

If you are going through a divorce or a civil partnership dissolution, you will also need to separate your finances from those of your ex-spouse or partner, eventually reaching a financial settlement.

Our local family law solicitors can assist you to try and reach a voluntary financial settlement, out of Court. We can assist you in obtaining a Financial Order, legally confirming the division of your assets and financial responsibilities. Where necessary, our solicitors can guide and represent you throughout Court proceedings.

We can also help you obtain a Clean Break Order, meaning that your partner will be unable to pursue any financial claims against you at a future date.

Pre & post nuptial agreements

If you are preparing to get married, having a prenuptial agreement can potentially protect your interests later down the line. Prenups are agreements between you and your spouse-to-be, outlining how your assets and financial responsibilities would be divided if you were to get divorced later on.

Post nuptial agreements serve the same purpose as prenups, the difference being that these are entered into once a couple is already married, instead of before. Our specialist family solicitors can help you to draft and enter into either agreement, providing bespoke advice related to your circumstances.

These types of agreements are also suitable for couples preparing to enter into, or already having entered into, civil partnerships.

Cohabitation agreements

Cohabiting couples are not afforded the legal rights that married couples or couples in civil partnerships are. This can often cause issues during the relationship, or issues if the cohabitating couple splits up. It is not uncommon for disputes to arise concerning ownership of assets, and financial obligations.

To help you avoid cohabitation disputes, we can help you draft a cohabitation agreement that reflects your needs and safeguards your interests.

These agreements are used to establish the responsibilities and rights of both partners, covering financial arrangements, debts, property ownership and other related issues. Clarifying matters like these can help couples when living together, or if their relationship ends later down the line.

Family mediation

If you find yourself facing a family dispute, family mediation can be a great way to resolve your issue amicably, and out of Court.

At Glanvilles Damant we can support you with family mediation. This method of alternative dispute resolution can be useful to resolve various matters, including reaching a financial settlement in the aftermath of a divorce.

High net worth divorce

Going through a high net worth divorce can potentially be a more difficult process in comparison to a standard divorce, particularly where finances are concerned.

Reaching a financial settlement during a high net worth divorce typically involves dividing a diverse range of assets. For instance, multiple properties, trusts, businesses, and offshore assets.

At Glanvilles Damant, we have much experience supporting high net worth couples to unravel complex financial situations. If you are going through a divorce, and you are concerned about protecting your interests, our friendly team can help.

Frequently Asked Questions About Divorce And Family Law

How can we avoid going to court?

Resolving family law matters, or obtaining a divorce, does not necessarily mean that you will need to go to Court.

Alternative dispute resolution methods, such as mediation or collaborative law, provide individuals and families with the opportunity to resolve legal matters without the need for Court proceedings.

What is mediation?

Mediation is an alternative dispute resolution process which provides individuals or families with the chance to solve legal problems and disputes, without going to Court.

These sessions are facilitated by a trained mediator, who guides the parties to put forward their needs and wishes, discuss their issues, and negotiate towards a resolution. The mediator is unbiased and does not provide legal advice. Both parties will need to have received independent legal advice prior to, and/or alongside mediation.

What is collaboration?

Collaboration refers to the collaborative law process, another form of alternative dispute resolution. This method can be used to resolve family matters, for example divorce, without going to Court.

Both spouses have their own lawyer, and the spouses meet, along with their legal representatives. The goal is to negotiate, making the necessary legal arrangements for the divorce.
