Frequently asked questions about divorce

What is the process of getting a divorce?

The process of ending a divorce or civil partnership is straightforward, especially given the recent introduction of no fault divorces. To begin with, either you, your partner, or both, must apply to a local family court, either online or through a solicitor.

Following this, there is a required 20-week ‘cooling-off’ period, in which the couple should reflect on whether a divorce is the correct decision and plan for their respective futures.

Next, the applicant will apply for a Conditional Order that, if approved, will allow a judge to issue a Certificate of Entitlement dictating that the couple is entitled to a divorce.

A secondary wait period of six weeks and a day must then elapse before an application can be made for a Final Order. Alongside these processes, finances must also be arranged, with a Financial Consent Order necessary to ensure a legally binding financial settlement.

Once the Final Order is obtained, the divorce or civil partnership is officially ended. When taking into account each stage, getting a divorce can take a minimum of six months, which can be lengthened if complex matters regarding children or assets are involved.

How much will my divorce cost?

Costs vary depending on your circumstances and the level of support required, but some fees are unavoidable. Currently, you must pay a court fee of £593 to get a divorce. Furthermore, approval of a Financial Consent Order costs £53.

If the couple cannot decide on a financial settlement, there is a further £275 fee for the court to issue financial proceedings. Likewise, if you cannot agree on child arrangements, the fee is £232 to issue children act proceedings.
