Injunctions & Occupation Orders on the Isle of Wight

Injunction Orders

Injunctions can be obtained from the Court at very short notice, sometimes on the same day. If the injunction is in the form of a non-molestation order, it will prevent your partner from assaulting, harassing or pestering you and/or your children.

It can also prevent your partner from coming within a certain area or distance from you. Such an injunction also applies to your partner getting someone else to threaten or intimidate you on their behalf.

Exclusion for Property

If you and your partner are living together, an occupation order can exclude your partner from that property.

This is to protect you and/or your children from harm. If the situation demands it, your partner could be ordered to leave the property immediately and be prohibited from returning.

Sometimes an injunction can be a combination of a non-molestation order and Occupation Order.

You will need to attend Court so that all the facts can be considered before a decision on an injunction is reached. Breaching an injunction is a serious offence and can be punished by imprisonment.
