He acted for a client in a Criminal Injuries Compensation Agreement ("CICA") claim following as assault at work where the client sustained a serious knee injury had to take early medical retirement. The client initially dealt with the claim himself and CICA made an award of £4,550. Stephen advised the client to apply for a review of the decision and CICA then awarded £63,000, however, Steve advised the client to appeal this decision because he believed the CICA were incorrect in their calculations regarding the injury tariff, along with the client's claims for past and future loss of earnings. The Appeal Tribunal agreed with Stephen's advice and the client was awarded £182,000.
He acted on behalf of the estate of the deceased who was knocked down and killed whilst walking along a country road late at night, there were no independent witnesses to the accident. The insurance company vigorously fought the claim both in regard to liability and quantum, but Steve was successful in negotiating a significant settlement for the benefit of the deceased's spouse and his children.
He acted for a man who sustained a serious shoulder injury at work, the insurance company on behalf of the employer denied liability and refused to consider any offers of settlement. Steve took the claim to trial establishing liability and recovered significant damages for the client.
He acted for a man who sustained a serious spiral fracture to his leg that meant he was unable to work in heavy manual employment that he had done previously. After establishing liability at trial, Steve secured rehabilitation treatment for the client and retraining to enable the client to set up his own business with the subsequent damages that were received.
He acted for a lady who was injured in what appeared to be a relatively minor road traffic accident. Liability was not an issue but the Defendants disputed the extent and the nature of the Claimant's injuries. Extensive medical evidence was required to prove the extent of the Client's injuries. Interim payment was obtained to arrange for private surgery that was successful. The claim was settled for a significant sum just prior to the trial date.
