1) Whiplash Reforms
According to research by the Association of Personal Injury Lawyers, government-led whiplash reforms have utterly failed victims of negligence and the wider public.
Injury awareness week has the aim of raising awareness of what it means to be injured by someone else’s negligence and the wider affect needless injuries have on society.
Whilst the motor insurance industry has saved £2.2 billion on injury claims and the costs to the industry have fallen by 19%, car insurance premiums have increased by 69%.
The purpose of the reforms was to pass on cost savings to motorists through their insurance premiums, but this has not happened.
2) Can I still claim if I am partly responsible for an accident?
One of the questions people often ask is “what if I am also partly to blame for an accident, can I still claim?”
The simple answer is yes, you can still claim. However, if you are partially to blame for an accident then the amount of compensation awarded by the Court will reflect that contribution towards the accident by a percentage reduction, but it is still worthwhile pursuing a claim and speaking to a specialist Solicitor about your eligibility to claim.
3) Access to justice
There are currently other plans in progress to limit further the legal costs which are allowed to be recovered in addition to compensation in a successful claim with the unfortunate consequence of restricting access to justice for those members of the public who are injured through no fault of their own as a result of someone else’s negligence.
