Court of Protection

The Court of Protection was established under the Mental Capacity Act 2005 and specialises in making decisions on welfare or financial issues for people who are unable or find it difficult to make decisions because they lack mental capacity.

When someone does not have a valid Power of Attorney in place, applications to the Court of Protection are made.

There are occasions even when there is a valid Power of Attorney in place, that a Court of Protection application may be required for decision making that goes beyond the Attorney’s powers.
