TUPE Solicitors on the Isle of Wight

TUPE (Transfer of Undertakings (Protection of Employment) Regulations 2006) is a piece of legislation designed to protect the employment rights of employees on the sale of all, or part of, a business or the outsourcing of a particular service to another business.

For employees, TUPE exists to protect their continuity of employment with unchanged conditions of employment. Employment is automatically transferred with the change of business and any dismissal is deemed automatically unfair (unless in narrowly defined circumstances). Employees must also be consulted regarding any proposals that affect them. Failure to do so could result in the employees receiving up to 13 weeks’ pay in compensation. If an employee’s conditions of employment change substantially due to the transfer, the employee may have the right to resign and claim constructive dismissal.
