Accessing mediation for parenting arrangements
If you’re separating and need to agree on childcare arrangements, mediation can be a far more constructive route than going to court. Mediation will help you create a plan that prioritises your child’s wellbeing, encouraging practical solutions that take everyone’s needs into account.
Rest assured that our team understands the emotional impact of parenting disputes. We can ensure that we will always support you with sensitivity and care.
If you are interested in accessing mediation for parenting arrangements, we can help you to do so, offering legal advice along the way.
Accessing mediation for financial settlements
Dividing finances and property can be one of the most complex aspects of divorce or separation. Our divorce solicitors can help you to access the mediation process, working towards reaching a fair and realistic settlement. During the process, you’ll negotiate with your spouse, to divide assets such as the family home, savings, pensions and ongoing financial responsibilities.
Our goal is to help you avoid lengthy and expensive court proceedings by resolving matters cooperatively. If you would like to discuss whether mediation is appropriate for you, we would be more than happy to help.
Making mediation agreements legally binding
Mediation can be helpful to resolve family disputes and reach agreements on financial and child residency matters. However, the outcome is not automatically legally binding.
We can assist you by turning an agreement into a legally binding court order once an agreement is reached. This gives you certainty and security, ensuring that all parties are clear on their rights and obligations moving forward.
Frequently asked questions about family mediation
What is family mediation?
Family mediation is a structured, confidential process in which a trained mediator helps separating couples discuss and resolve issues such as child arrangements, finances, and property division. It provides a neutral space to work out practical solutions without the need to go to court.
What are the benefits of family mediation?
Family mediation offers several advantages, including:
- Avoiding the stress and cost of court proceedings
- Encouraging cooperation and reducing conflict
- Creating longer-lasting, mutually agreed outcomes
- Providing a faster route to resolution
- Supporting families with a more personal, flexible approach
What happens during the mediation process?
During mediation, both parties attend a series of sessions (either together or separately), facilitated by a trained mediator. You’ll have the chance to discuss the issues that matter most, such as where the children will live or how finances will be split, and the mediator will help you find common ground. Any agreement reached can then be drafted into a written document, and your solicitor can assist in making it legally binding.
Do I have to attend mediation before going to court?
In most cases, yes. Before making any court application about child arrangements or finances, you’ll need to attend a Mediation Information and Assessment Meeting (MIAM) to explore whether mediation is suitable.
However, there are some exceptions, for example, where there has been domestic abuse. We can advise you on whether mediation is the right route for you, and advise on alternative options should our expert team believe that a different route would be more effective.
How can Glanvilles Damant help?
Our solicitors offer tailored legal advice before, during, and after mediation sessions. We can guide you through the process, help you prepare, ensure your rights are protected, and make any agreement legally binding if needed.
